Habitual infractions in jurisprudence and law

Abstract

In the Libyan Penal Code, crimes are divided according to the necessity of the act constituting the material element of the crime into simple infractions and habitual infractions. In infractions of habit, the criminalization is focused on habituation to the act, and not on the act itself. In this research, we seek to clarify the reason for criminalizing this type of crime and the effects of that division, while reviewing the images of these crimes in Islamic jurisprudence and the Libyan Penal Code and comparing them.
