Abstract

This research explores how digital transformation has reshaped the concept of nullity in statements of claim and the ways procedural errors can be corrected within the Saudi e-justice system. As the judicial process has shifted from traditional paperwork to fully digital platforms, filing a claim is no longer a simple administrative step; it now requires precise compliance with electronic forms, identity verification tools, and automated system requirements.

The study explains how this shift has reduced many traditional errors through smart templates and built-in validation checks, while at the same time creating new types of procedural defects, such as technical system failures, incorrect digital identity verification, or issues with uploading required documents. It also examines the electronic correction mechanisms provided by the Ministry of Justice, and the extent of the judge’s discretion in assessing whether an error affects the validity of the proceedings.

The findings show that digital transformation has not eliminated procedural nullity, but it has redefined it. This evolution highlights the importance of updating legal frameworks to ensure fairness, clarity, and stability in digital judicial procedures.
