Abstract

Islamic law gave the wife great care, and granted her material and moral rights towards her on the basis of wisdom and justice, and caring for the interests and well-being of both spouses. Among the rights of the wife over her husband are: Financial rights: such as dowry, comfort and alimony, breastfeeding and custody, housing and inheritance, and non-financial rights: such as learning and understanding the religion, her approval of the husband, her kindness to her parents, her right to cohabitation in a reasonable manner, and her right to divorce. The continuity of married life depends on the continuity of love between the spouses, and love is sound love, which after marriage turns into a feeling of mutual affection and compassion between the spouses, and a feeling of duty placed on each of them, so that understanding, tolerance and contentment prevail in marital life. This is why it was necessary to have rights for both spouses. So that a happy life can be established based on piety and cooperation, and that love, familiarity, and good treatment may endure, and so that flawless serenity and purity may endure. The marital relationship is by nature a spiritual and moral relationship, and this is what the Sharia has encouraged and recommended: The Almighty said: “And among His signs is that He created for you from among yourselves.” mates that you may find tranquility with them, and He has placed between you affection and mercy... (Al-Rum: 21)
